1. Acceptance of Terms

By creating an account or using CURRENTly ("the App"), you agree to these Terms of Service. If you do not agree, do not use the App.

The App is operated by M&H Tech, LLC ("we," "us," or "our"). You can reach us at hello@divecurrently.com.

2. CURRENTly Premium Subscription

CURRENTly offers an auto-renewing subscription called CURRENTly Premium.

Price: $49.99 per year (introductory launch pricing may apply)
Free trial: 30 days free for new subscribers
Renewal: Your subscription automatically renews at the end of each billing period unless cancelled at least 24 hours before the renewal date
Billing: Payment is charged to your Apple ID at confirmation of purchase and at the start of each renewal period
Cancellation: You can cancel at any time through iOS Settings → Apple ID → Subscriptions. Cancellation takes effect at the end of the current paid period — you will not receive a refund for the remaining time
Price changes: We may change the subscription price with reasonable notice. Continued use after a price change constitutes acceptance

3. User-Generated Content

CURRENTly allows users to post dive logs, photos, comments, and sightings ("Content"). By posting Content, you confirm that you own it or have the right to share it, and you grant us a non-exclusive license to display it within the App.

You are solely responsible for your Content. We do not endorse or verify any Content posted by users.

4. Prohibited Content

You may not post Content that:

Is sexually explicit, violent, or graphic
Harasses, threatens, or bullies other users
Is false, misleading, or fraudulent
Violates any applicable law or regulation
Infringes on the intellectual property of others
Contains spam or unsolicited advertising
Misidentifies species or dive sites in a way intended to deceive

5. Content Moderation and Enforcement

We reserve the right to remove Content that violates these Terms at any time without notice. Users may report posts using the in-app report button. You can also block other users directly from any post, which immediately removes their Content from your feed.

Repeated violations may result in account suspension or permanent termination.

6. Intellectual Property

The App, its design, logo, and original content are owned by us and protected by copyright. You may not copy, reproduce, or redistribute any part of the App without written permission.

7. Disclaimer

The App is provided "as is" without warranties of any kind. Dive information, species identifications, and site data are user-submitted and may be inaccurate. Never rely solely on the App for dive safety decisions. Always follow proper dive training and safety procedures.

8. Limitation of Liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the App.

9. Termination

We may suspend or terminate your account at any time for violations of these Terms. You may delete your account at any time through the App settings.

10. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes are posted constitutes acceptance of the updated Terms.
